The hearing was held in the above styled matter on January~23
1979 on Defendants EAGLE FAMILY DISCOUNT STORES, INC. and WILLIE
BAKER'S Motion for a Summary Judgment in the above styled matter;
`s also heard was an Ore Tenus motions by the attorney for the
Plaintiff for a Protective Order to prevent the taking of the

motion of the Plaintiff by their attorney to compel Eagle Family

~.Discount Stores, Inc. to prepare and provide for them a net worth

statement of the Defendant at the Pre-trial Conference and further
the written Motion for Compulsory Physical Exam by the attorney for
the Defendants. The Court having heard argument and being otherwise
sufficiently advised in the premises, it is hereby
~ ORDERED AND ADJUDGED as follows:

1. The Defendants' Motion for Summary Judgment is hereby
denied.
2. The. Plaintiff's Ore Tenus motion for-a Protective Order
~ is hereby denied and the Plaintiff is ordered to appear for his
deposition at the time set on February 13, 1979.
~ ~ 3. The Plaintiff's Ore Tenus Motion to Compel Eagle Family
Discount Stores, Inc. to produce a statement of their net worth is
hereby granted. Said statement must be provided to the Court at the
time of the Pre-trial Conference but is not to be released to the

Attorney for the Plaintiff until the time of trial if it is
admissible.
