in Paragraph 6(a), and petitioner has determined that said
corrective quit-claim deed was necessary by virtue of the
fact that no trust agreement in writing dated May 15, 1967 tistingthe
subject property as ~sn asset
ever existed. In the absence of such written trust agreement,
petitioner is advised that the effect of said deeds was to vest
fee simple title to the above real property in the wards, by
virtue of the Statute of Uses, Flo_ ride Statutes S689.09.
8. During her lifetime, D. Alviena Huber, as Trustee,
.entered into a favorable contract for sale of the real property
more fully described in Paragraph 6 with Donald B. Medalie,
Trustee, which contract for purchase and sale appears among the
public records of St. Lucie County, Florida, in O. R. Book 254
at pages 226 through 229, inclusive. Deeming it in the best
interest of the wards, petitioner, as guardian, endeavored to
carry out the obligations of seller contained in said contract.
To that end, an attorney at-law was employed in the State of
Florida to qualify as guardian of the Florida property of the
non-resident wards and to take all other steps. reasonably required
to effect a valid sale and conveyance to Donald Medalie, as
.Trustee. Said attorney indeed qualified as "ancillary guardian"
in Probate Division Case No. 76-248, the style of-which is more

i -fully set forth in-Paragraph S.hereof, and pursuant to Court order
` dated August 10, 1976, closed the sale contemplated by said
contract by executing and delivering an "Ancillary Guardian's
Deed", recorded in O. R. Book 264 at page 297 of the public
records of St. Lucie County, Florida, and receiving full payment
of the purchase price.
9. Petitioner. in all respects confirms the sale-and
~ conveyance effected by said "Ancillary Guardian" and acknowledges

that it has received as domiciliary guardian all proceeds of

sale which are now held as part of the domiciliary guardianship
estates of Rita-Marie Huber and Nancy Jean Huber, minors.
