THIS CUASE coming on for hearing this 30th day of January,

1979, upon the Motion to Dismiss filed by the Defendants, and the
Court having heard argument of counsel and being otherwise fully -
advised in the premises, it is upon consideration .
ORDERED AND ADJUDGED as follows:
(1) That the Motion to Dismiss. as to Count II of the
Complaint, the Count for quiet title, be and the same is hereby
granted, and said Count II be and the same is hereby dismissed.
(2) That the Plaintiff shall have fifteen (15) days from
the date of this Order to file~an Amended Complaint amending Count II,
and the Defendants shall have-thirty-five (35) days from the date of
f this Order to plead to the Complaint and the Amended Complaint.

F (3) That a plat or diagram designating the properties
p described in the Complaint and designating the various easements g
that are described in the Complaint shall be filed as an attachment
~ to the Amended Complaint when filed.
