IN TH8 CIRCUIT COURT OF THE SEVENTEENTH
JUDICIAL CIRCUIT, IN AND FOR BROWARD
COUNTY, FLORIDA. •
Case No. 78-7754 "J" LEE
IN RE: THE MARRIAGE OF
WILLIAM GABLE, : ~ ;
_ Petitioner,
_ _ FINAL JUDGMENT
-and-
.
NANCY GABLE , T+w ~ L
Respondent.
. .
• THIS CAUSE came on to be heard this day, for final hearing
before this~Court and the Court having considered the evidence and
testimony of the parties and their respective witnesses, and the
Court being otherwise duly advised in the premises, hereby finds
as follows:
1) That at the time of the execution of the Property
Settlement Agreement as between the parties dated 3/27/78, and
introduced into evidence as .Respondent's Exhibit "I", both parties
had full knowledge and appreciation of the terms and conditions set
forth therein and that both parties had separate individual compe-
tent attorneys and were counselled by said attorneys relevant to
the terms and conditions set forth therein, prior to the execution
thereof.
E 2) The parties did not', in fact, reconcile following the
execution of the above Agreement, although it was uncontradicted
~ -that the Wife, four days-after the execution of the Agreement,
invited the Husband to return to the marital domicile and commence
cohabitation, and that the said four days was a reasonable period
of time under the circumstances. .The Husband refused to do so.
~ The Court finds that the failure of the parties to reconcile
after the execution of the Agreement, 3/27/78, was due to the
fault of the Husband and not the Wife. The Court therefore finds
''r
that the Property Settlement Agreement is a valid and existing
Agreement and approves it, incorporating it into the terms of this
Final Judgment.
