THIS CAUSE came on to be heard on the 16th day of
January, 1979 upon the Defendant's Motion to Strike and Motion
to Abate Action, and the attorney for the Plaintiff having announced
to the Court that the attorneys for the Plaintiff and Defendant had

reached an agreement by telephone, on January 15, 1979, and the
Court having heard said agreement in open Court, and being otherwised
fully advised of the premises, it is thereupon

ORDERED AND ADJUDGED, as follows:

1. That the Motion to Strike the allegation of attorney's
fees in the Plaintiff's Complaint, be, and is .hereby ordered granted. -
2. That the Motion to Abate Action filed. by the Defendant
in-this cause, be, and is hereby granted, and the Clerk of the County
Court in and for Saint Lucie County, be, and is hereby ordered to
transfer this cause to the Cler}c of the County Court in and for Martin
Count for-filin in Martin Count Court.
