MAINVILLS, - Plaintiff, - - - vs JOE FORD, Defendant. FINAL JUDGMENT This action was tried before the court. On .the evidence presented, it is - ADJUDGED: - 1. The Defendant, having abandoned its counter- claim, judgment is therefore entered on behalf of the Plaintiff on same. - - 2. On the issue of negligence, the court finds the Plaintiff was not guilty of any negligence and that 100$ of the negligence is attributable to the Defendant, JOE FORD, based-upon his vicarious .liability .for the actions of the operator of his motor vehicle, DONALD L. FORD. 3. The Plaintiff did not sustain his burden on the issue of punitive damages and, therefore, no such damages are awarded. 4. On the issue of compensatory damages, the court finds the total amount of damages sustained by the Plain- tiff is $140,000.00. However, the court further finds that damages are limited by the final judgment entered - in the case of DAVID V. MAINVILLE VS DONALD L. FORD being case number 78-181CA entered in the Circuit Court of the 19th Judicial Circuit, in and for St. Lucie County, in a the amount of $98,000.00 with credit being given for p partial satisfaction of that judgment. $10,000.00 aid in sooK 3U2 ~~~E 2561 - z 5 -
