seasons.
5. Buyer agrees that Grower may convey the grove or groves
covered by this~Agreement at any time. If the closing on'the
conveyance occurs after July 30 but before September 15, this
Agreement shall terminate and Buyer will not be entitled to
the fruit grown during the following growing season. If, however,
the closing on .the conveyance occurs on or after September 15,
Buyer shall be entitled to the fruit grown during the following
growing season.
6. Buyer acknowledges that some of the citrus crops covered
by this Agreement are subject to a~prior commitment by the Grower.

subject to this prior commitment, but all of the citrus crop
for the 1978-79 season that is not .subject to the prior commitment
shall be sold to Buyer in accordance with the provisions hereof.
