• The parties, by and through their undersigned counsel,
herein jointly stipulate and move this Honorable Court for dis-
missal of the remaining claims in this action as follows:
1. The Court having previously entered an order appro- ,
ving the.settlement of Counts I, II and IIZ, and the Court retain-
ing jurisdiction for~the determination of attorney's fees.as to
Counts I, II and III, and the parties having amicably settled the
attorney's fee dispute, the parties mutually stipulate and move
the Court for dismissal with prejudice as to Counts I, II and III.

I'i 2. The Court having previously entered a partial judg-

~ ment on the pleadings as to Count IV of Plaintiff's Complaint,
~ and the parties having amicably settled the dispute arising from
the petition for declaratory relief, sought in Count IV of the
Complaint, the parties mutually stipulate and move this Honorable
Court for dismissal with prejudice as to Count IV of Plaintiff's
Complaint: ~
3. Count V of Plaintiff's Complaint, being an action
for personal injury protection benefits and medical payments
benefits under the insurance contract issued by the Defendant
