made by the party of the second part on this contract; and such ;
payments shall be retained by the ~aid party of the first part in k

full satisfaction and liqu~dation of all damages by first party
sustained, and the party of the first part shall have the right to
re-enter arid take posaession of the premises aforesaid without being

liable to any action therefor. - ~
IT IS MUTUALLY AGREED by and between the parties hereto that ~
the time of payment~shall be an essential part of this contract and ~
that all covenants and.agreemente herein contained shall extend to -
and be obligatory upon-the heirs, executors, administrators and as-
signs of the respective parties. . .
IT IS FURTHER MUZVALLY AGREED by and between the.parties hereto -
that :
(a) The second party shall be responsible for the full main-

tenance, upkeep of the groves and shall maintain the same in ac- ~
~

cordance with good agricultural and husbandry standards. ~

(b) The second party shall keep the said groves and its equip-
ment fully insured for the use and benefit of the first party as
~ their interests appear. - ~
; (c) The second party shall be responsible for any and all ~

~ cost of any nature whatsoever as the same applies to the operation ~

~ and maintenance of the said real property and grove being the sub- -
~ ject matter of this ~gree~ent, and at no time will permit the said ~
~
~ land or the agricultural product and trees, etc.. including the
f
equipment thereon, to be the subject matter of any liens which would ~
attach to the land and became the resp.onsibility of the first part3~,
it being the intention of the parties hereto that the second party
~ t
shall be fully responsible for any and all cos~, taxes, insurance,
maintenance, operational expenses, repairs, assessments, etc. ~

~ (d) The second party agrees, and shall upon the execution of ~
~
~ this Agreement, publish in the Counties of St.-Lucie and Okeechobee, ~
Florida, fictitious name ads and register the same as follows: ~
L. RALPH POPPELL d/b/a PULITZER GROVES; ~
