This cause having come before the Court on the Plaintiff's
Motion to Dismiss the Affirmative Defenses contained in Defendant's
Answer, and the Defendant's Motion to Dismiss end/or Abate this
cause; and the, Court, having heard arguments of counsel, and being -
otherwise fully advised in the vremises, it is -
ORDERED AND ADJUDGED as follows:
1. Plaintiff's Motion to Dismiss the Affirmative Defenses -
contained in Defendant's Answer is denied as to Defendant's First
Affirmative Defense, and said defense shall stand as filed, and
2. Plaintiff's Motion to Dismiss the Affirmative Defenses

'f contained in Defendant's Answer is granted as to the Defendant's.
Second Affirmative Defense, and Defendant shall have fifteen (15) days

from the entry of this Order to amend said Affirmative Defense, and z

3. Defendant's Motion to Dismiss and/or Abate is granted
only to the extent that this cause will not be set for trial during
the next sixty (60) days.
