upon Defendant's Motion to Dismiss for failure of timely
prosecution, and this Court having considered the merits
of said motion, having entertained oral argument of counsel
in support of their respective positions, and having otherwise
been fully advised in .the premises, it is,
- ORDERED AND ADJUDGED that Defendant's Motion to Dismiss
for failure of timely prosecution is hereby granted and
that this cause is therefore dismissed without preju3ice.
