HomeMy WebLinkAbout2415 on the day of , 1979, all as pro- vided by Sec ion 45.031 of the Florida Statutes. 10. That out of the proceeds arising from the sale of the property by this judgment ordered to be sold, the Clerk shall retain his fee and-shall pay to the attorney for the Plaintiff the attor- ney's fees allowed in this decree; that out of the remainder of the. proceeds as far-as they shall apply there shall be paid to the Plaintiff the sums above provided in paragraph 5, together with the costs of this suit advanced by the Plaintiff; if-the property shall .sell for more than enough to pay the Plaintiff the above mentioned sum with interest, the remainder of the proceeds as far as they shall - apply shall be paid to the attorney for the Crossclaimants and `the Crossclaimants the sums above provided in paragraph 7;-and that if the property shall sell for more than enough to pay the Plaintiff and the Crossclaimants the above mentioned sums with interest, the Clerk shall report the surplus to this Court for the Court's further- order; that in the event the amount realized at the sale be insuffi- cient to pay .the total of the several amounts by this decree ordered to be paid, the Clerk shall report the deficiency to the Court for such further orders as the Court may deem proper. 11. Plaintiff and Crossclaimants may bid at the sale, and if either Plaintiff or Crossclaimants are. the successful bidder, it shall be entitled to credit on its bid up to the full amount due it F ~ - _ - ( under this judgment. E 12. That upon the sale being had in accordance with Section 45.031 of the Florida Statutes, and-upon -the Clerk filing the certi- - ficate of sale, and upon the Clerk filing the certificate of title as provided by Section 45.031 of the Florida Statutes, the sale shall ~ stand confirmed and the Defendants and Crossdefendants and all per- sons claiming by, through and under them shall be forever barred and foreclosed of any equity or right of redemption in and to the E above described property, and the purchaser at the sale or the pur- chasers, their heirs, representatives, successors or assigns, without - - - -5- - r ~ ba~~ ~ItCf~ - x.
