Plaintiffs, CHARLES J. HAYDE and MARGUERITE HAYDE, -
and Defendant, FIRST NATIONAL BANK AND TRUST COMPANY OF
STUART, by and through their respective undersigned attorneys,
hereby stipulate and agree that FIRST NATIONAL BANK AND TRUST
COMPANY OF STUART shall be and said Bank is hereby dismissed
without prejudice as a party to this action on grounds that
such Bank holds a mortgage on the subject property superior
to the mortgage sought to be foreclosed in this action and
i therefore the Bank is not a necessary party to this foreclosure.

f Plaintiffs and Defendant, FIRST NATIONAL BANK AND TRUST COMPANY
OF STUART, shall bear their own costs and attorneys' fees, if
~ any, incurred against each-other to the. date of the dismissal.
