. PARTIAL RELEASE OF MORTGAGE
KNOW ALL MEN BY THESE PRESI:NTS, Whereas, Bay Colony of Stuart, Inc, by
indenture of Mortgage bearing da[e the lOth day of November A.D. 1977,
and recorded in the office of the Clerk of the Circuit Court in and for
the County of St. Lucie , State of Florida, in O.R. Book
277 , Page 334 and modified by Modification Agreement between
the parties, dated December 4, 1978 and recorded in O.R. Book 299 Page ~
289 , granted and conveyed unto FIRST FEDERAL SAVINGS AND LOAN AS-
SOCIATION OF FORT PIERCE and assigns, the premises theYein particularly
described, to secure the payment of the sum of SEVEN HUNDRED TNOUSAND
AND NO/100 DOLi.ARS ($700,000.00) with interest as therein mentioned:
AND WHEREAS the said BAY COLONY OF STUART, INC. has requested the said
FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF FORT PIERCE to release the
premises hereinafter described, being part of said mortgaged.premises,
from the lien and operation of said Mortgage:
NOW, THEREFORE, KNOW YE, That the said FIRST FEDERAL SAVINGS_AND LOAN
ASSOCIATION OF FORT PIERCE, as well in consideration of the premises as
the sum of one dollar and other good and valuable consideration dollars,
to it in hand paid by the said BAY COLONY OF STUART, INC, at the time of
the execution hereof, the receipt whereof is hereby acknowledged, does
remise, relase, quitclaim, exonerate and discharge from the lien and
operation of said mortgage unto the said BAY COLONY OF STUART, INC.,
their heirs and assigns, all that pierce, parcel or tract of land, being '
a part of the premises conveyed by said mortgage, to-wit:
Lot 24, BAY COLONY OF STUART, according to the plat
thereof on file in the office of the Clerk of fhe
Circuit Court, in and for St. Lucie County, Florida,
in Plat Book~_, Page ~
TO NAVE AND TO HOLD the same, with appurtenances, unto the said BAY
COLONY Oz STUART, INC. and assigns forever, freed, exonerated and
discnarged of and from the lien of said mortgage, and every part there-
of; Provided, always, nevertheless, that~nothing therein contained
shall in anywise impair, alter or diminish the effect, lien or in- .
cumbrance of the aforesaid Mortgage on the remaining part of said '
mortgaged premises, not hereby released therefrom, or any of the rights
; and remedies of the h~lder thereof.
IN WITNESS WHEREOF, the said Mortgagee by its duly authori~ed officers,
~ has hereunto set its hand and seal this ~ day of February, 1979.
