THIS CAUSE came on to be_ heard upon the Defendants' biotion
for Summary Judgment~ and the Court having examined the deposition
on file of JI]?i SHEE!iAN, the President of the Plaintiff Bank, the
Affidavit of Defendant~ S. J. BROSILOW, the pleadings and having
heard the argument of counsel for the respective parties, the Court

1. '!'hat the agreement labeled ~efendants' Exhibit "B" for
identification and attached to the deposition of JIM SHEEHAN,

~ President of the Plaintiff Rank, is a partnership agreement.

; 2. That the Plaintiff as judgment creditor of S. J. BROSILOW

; has the legal right to levy upon the interest of S. J. BROSILOW
~
~ in said partnership agreement.
