ORDER
THIS CAUSE came on to be hear3 February 20, 1979, upon the Vlife's
Amended Petition for riodification, and upon the taking of testimony, and
upon the argument of counsel, and upon the Court finding that there has
been a material change in circumstances between the parties in that ~
JANET SCIiMIDT has been residing with her mother since September, 1977,
and upon the Court bei~ng otherwise fully advised in the oremises, it is
ORDERED AND ADJUDGED that the Final Judgment of Dissolution of
Marriage entered April 6, 1973, and the Modification Order of this Court
entered December 31, 1975, are hereby modified as follows:
, 1. CUSTODY. ANNETTE R. SCHMIDT shall have the care, custody,
~ and control of JANET SCHMIDT for so long as JANET SCHMIDT maintains a
~ C average in her school work, beginning with the next grading period

~ at the high school atterx~~ed by JANET SCHMIDT. In the event that the
~
~ academic average of JF~vET SCHMIDT falls below the level of C, then the
R
~ carer custody, and control of JANET SCI-iriIDT shall revert to
~
~ RICHARD G. SCHMIDT.
~
~ 2. CHILD SUPPORT. RICHARD G. SCHMIDT shall pay to ANNETTE
~
~ R. SCHt~1IDT the sum of $60 per Month towards the support of JANET SCHi~IIDT.

Said surn shall be gaid on or before the first day of each month, with
the first payment coming due isarch 1, 1979.
~ 3. NiEDICAL EXPENSES. The husband, RICHARD G. SCHi~1IT, shall

maintain medical insurance for the care of JANET SCHMIDT. In addition,

~ the husband shall be responsible to pay for all medical, dental, a
2-~ orthodontic, and optical bills incurred by JANET SCHMIDT over and ,
