THIS CAUSE having come on before the Court for hearing

on the issue of a permanent injunction on the 22nd day of
February, 1979, and the parties having made certain concessions,
agreements and stipulations, and the Court being fully advised
of the same, and of the issues remaining, does hereby find as
follows: '

(1) The Defendant, MEL ELKINS, did engage in certain ~
activities interfering with the business and operation of the
FORT PIERCE CITY MARINA; ~
(2) The CITY OF FORT PIERCE CITY MARINA is without an
adequate remedy at law to preserve and protect the operation

of its facilities and to preserve and protect the safety and ~

~ well being of its tenants, customers and potential tenants and

~ ORDERED AND ADJUDGED AND DECREED by this Court, that the

~ CORPORATION, INC., a dissolved Florida corporation, his associates,

~ agents, servants, employees and assigns, be, and they are hereby,

jointly and severely, enjoined and restrained from the further
:r performance or doing of the following enurierated acts:

= (a) Anchoring, berthing or otherwise positioning his
boat within the channel east of the Fort Pierce City Marina,
