DECLARATION OF CONDOMINIUM
OF
HIGH POINT OF FORT PIERCE CONDOMINIUM SECTION II
HIGH POINT EQUITIES, INC. , a Florida corporation, as the .owner in fee
simple of the "Land" (as hereinafter defined) hereby makes this Declaration of
Condominium of High Point of Fort Pierce Condominiwn Section II (the "Decla-
ration") to be recorded amongst the Public Records of St. Lucie County,
Florida, where the Land is located and states and declares:
I. SUBMISSION STATEMENT
High Point Equities, Inc. hereby submits the "Condominium. Property",
as hereinafter defined, to condominium ownership pursuant to U:e Condominium
Act, Chapter 716, Florida Statutes, 1976, as heretofore amended (the "Act").
This is a "Phase Condominium" as contemplated by Section -718.403 of the Act.
The plan created by the several Phases of this Condominium is set forth in
Articles V and VI hereof .
II. NAME
The name by which the condominium created hereunder (hereinafter
referred to as the "Condominium") and the Condominium Property are to be
identified is
HIGH POINT OF FORT PIERCE CONDOMINIUM SECTION II
- III. LAND f
The legal description of the land included in the Condominium Property
and submitted herewith to condominium ownership (herein referred to as the
"Land") is attached hereto and made a part hereof as Exhibit A . The term
"Land" shall also include each of the "Phase II Land" , "Phase III Land" ,
"Phase 1V Land", "Phase V Land", "Phase VI Land", "Phase VII Land",
"Phase VIII Land" , "Phase IX Land" , "Phase X Land" , "Phase XI Land" ,
"Phase XII Land" , "Phase XIII Land" , "Phase XIV Land" , "Phase XV Land"
and "Phase XVI Land" (as such terms are hereinafter defined) if, as and
when same are added to High Point of Fort Pierce Condominium Section II '
pursuant to this Declaration in accordance with Articles V and VI hereof .
IV. DEFINITIONS
The terms contained in this Declaration shall have the meanings given
such terms in the Act, and for clarification the following terms have the
following meanings
A . "High Point of Fort Pierce Condominium Section II" or the "Condo-
minium" means certain land and improvements in the City of Fort Pierce, St.
a Lucie County, Florida, which are submitted to condominium ownership pursuant
to this Declaration of Condominium or pursuant to an amendment hereto.
