ORDER AND PARTIAL SUMMARY FINAL JUDGMENT
THIS CAUSE, having come to be heard before me on January 24,
1979, upon~Motion of the Plaintiff, SIERRA LAND & CATTLE CO., for
Summary Judgment and to strike Affirmative Defenses of the Defendant,
DONALD J. NANDKINS, and upon Motion of the Plaintiff ore tenus to treat
the Affirmative Defenses of DONALD J. HANDKINS as a confession of
judgment, and this Court being otherwise fully advised in the premises,
it is, upon consideration,
ORDERED AND ADJUDGED as follows: -
1. Plaintiff's Motion for Summary Final Judgement against KAREN

Y. EVANS, f/k/a KAREN Y. HANDKINS, be and the same is hereby granted.
~ 2. Plaintiff's Motion for Summary Final Judgment against DONALD
J. HANDKINS be and the same is hereby denied as to foreclosure, t s
Court finding that a factual matter has been raised by the pleadings,
except, however, a partial summary final judgment against DONALD J.
HANDKINS is granted as to $ 2,50.88 which represents payments
from January, 1978, to the present time.
3. Plaintiff's Motion to Strike Affirmative Defenses is granted
as to Paragraphs 1, 4 and 5. As to Paragraphs 2, 2 and 3, Plaintiffs

Motion to Strike is denied.
