THIS CAUSE having come before the Court on
February 22, 1979 on Plaintiffs' motions to dismiss designated
defendants and for a partial summary judgment on t!~e issue
of liability and the Court having heard argument of counsel
and being otherwise advised in .the premises, it is hereby
ORDERED and ADJUDGED:
1. That at the hearing the Plaintiff orally
requested that he be allowed to withdraw his motion dismissing
designated defendants and there being no objection from counsel,
~ said motion is withdrawn.
2. That the Court finds there are disputed
issues of material fact and therefore the Plaintiff's motion
for partial summary judgment on the issue of liability is
denied.
DONE and ORDERED this day of March, 1979
at Florida.
