in and as shall have opposed such acts or proceedings. If
all of my devisees, legatees and benificiaries shall parti-
cipate in such proceedings, I give, devise and bequeath the
whole of my estate to my heirs at law according to the laws
of succession of the State of Ca]-ifornia then in farce,
excluding all contestants, all persons conspiring or cooperating
with them, and said devisees, legatees, heirs and beneficiaries
and their successors in interest. My Executors, as named ,
herein, are specifically authorized and directed to defend
at the expense of my estate, any contest or attack of any
nature upon this Wi11 or upon any paragraph or provisions
of .this Will.
LASTLY: I hereby nominate and appoint the Bank of America
National Trust and Savings Association and said Marilyn Louise
Bolcer Executors of this, my Last bill and Testament; and .
in the event of the inability of our said daughter to so-act,
I hereby nominate and appoint Richard T,eroy Muckenthaler as
such co-Executor, and I hereby revoke all former Wills by
me mare. It is my wish and I hereby direct-that all probate
commissions for both ordinary and extraordinary services -

be pai~ to said bank, and that the sum of $5,000.00 be .
paid to either our said beloved daughter or our said beloved
son for acting as such Executor. In the event that ancillary
probate proceedings are required in the State of Florida,
it is my wish and I hereby direct that the First National
Bank of Fort Pierce, Florida, be appointed Executor of my
estate in Florida, and that it retain the legal services of
Norman L. Paxton, Jr. of the law firm of Brown, Paxton and
Williams of Fort Pierce, Florida, to act as its legal counsel.
In connection with the probate proceedings in California, _
~ it is my wish and I hereby direct that my long time attorney,
Stephen F. Gallagher, be appointed to represent said Executors.
