HomeMy WebLinkAbout0062 prior to entry of a judgment e~forcing this Mo~tgage if: (a) Borrower pays Lende~ all sums~which would be then due under this Mortgage. the Note and nota securing Futurc Advances, if any. had no acceleration occurred; (b) Horrower cures all breacha of any other covenants or agreemeots of Bortowe~ contained in this Mon~age; (c) Borrower payi all reasonable expenses incurred by Lender in enforcing the covenaqts and agrcements of Borrower contained in this Mortgage and in enforcing l.ender's remedies u provided in paragraph 18 herco(, including, but not limited to. reaso~able attomey i foes; and (d) Borrower takes such action as l.er~der may reasonably require to assure that the lien of this Mortgage, I.ender'a interest in tAe Propetty and Borrowsr's obligation to pay the sums securcd by this Mortgage shall continue unimpaired. Upon auch payment and cure by Borrower. this Mongage and the obligations secured hereby sAall rcmain in full tora and effxt as if no acceleration had occurred. 20. Assitnmeot of Reatfi Appointmtat ot Recelrer. As additional xcurity hercu~der. Borrower hereby assigns to I_ender the rcnts of the Property, provided that Borrower shall, prior to 3ccele~ation under paragraph 18 hercof or abandon- mem of the Property, have the right to collect and retain such re~ts as t6ey become due and payabk. Upon acceleration under paragraph 18 hercof or abandonmtnt of the Properiy, Lender shall be entitled to have a ' receiver appointed by a court to enter upon, take possession of and manage the Property and to collect the rents of the Property. including thox past due. All rents collectecl by the receiver shali be applied Brst to payment of the costs of management of the Property and collection of rents, including, hut not limited io, receiver's fees, premiur.u on receiver's bonds aod reasonabk attorney's fees, and then to the sums secured by this Mortgage. The t~eceiver shall be liable to account only for those rcnu actually rcceived. 21. Fot~re Advancea. Upon request by Borrower, I.ender, at I.ender s option within twenty years from the date of this Martgage, may make Future Advances to Borrower. Such Future Advances, with intercst thercon, shall be securcd by this Mortgage when evidenced by promissory nutes stating that said notes are secured hereby. At no time shall the principal amount of the indebtedness secured by this Mortgage, not i~cluding sums advanced in accordance herewit6 to protect the ' security of this Mortgage, eaceed the original amount of the Note plus USS- 22. Rekase. Upqn payment of all sums secured by this Mortgage, Lender shall release this Mortgage without charge to Borrower. Borrower shall pay all costs o[ recordation, if any. 23. Aftorney's Fees.
