D. Section 37. of the Mortgage is modified by inserting, after the
present final paragraph, the following as a final paragraph:
Anything in this Indenture to the contrary notwithstanding, the
Company may have fire insurance policies with a deductible provision
in a dollar amount per occurrence not exceeding 396 of the bonds
Outstanding hereunder on the date such policy goes into effect,
provided, however, such dollar amount may be exceeded to the extent
such dollar amount per occurrence is below the deductible amount in
effect as to fire insurance on property of similar character insured by
companies similarly situated and operating like properties.
SECrtON 2. Subject to the amendments provided for in this Thirty-sixth
Supplemental Indenture, the terms defined in the Mortgage, as heretofore
supplemented, shall, for all purposes of this Thirty-sixth Supplemental
~I Indenture, have the meanings specified in the Mortgage, as heretofore
t supplemented.-
~ SECTION 3. The Trustees hereby accept the trust herein declared,
provided, created or supplemented and agree to perform the same upon the
terms and conditions herein and in the Mortgage, as heretofore supple-
mented, set forth and upon the following terms and conditions:
The Trustees shall not be responsible in any manner whatsoever for or
in respect of the validity or sufficiency of this Thirty-sixth Supplemental
' Indenture or for or in respect of the recitals contained herein, all of which
recitals are made by the Company solely. In general, each and every term
and condition contained- in Article XVII of the Mortgage, as heretofore
amended, shall apply to and form part of this Thirty-sixth Supplemental
Indenture with the same force and effect as if the same were herein set forth
in full with such omissions, variations and insertions, if any, as may be
appropriate to make the same conform to the provisions of this Thirty-sixth
Supplemental Indenture.
- SECTION 4. Whenever in this Thirty-sixth Supplemental Indenture any
of the parties hereto is named or referred to, this shall, subject to the
provisions of Artides XVI and XVII of the Mortgage, as heretofore
amended, be deemed to include the successors and assigns of such party,
and all the covenants and agreements in this Thirty-such Supplemental
Indenture contained by or on behalf of the Company, or by or on behalf of
