PARTY WALL AGREEMENT .
THIS AGREEMENT, made and entered into this
day of March, 1979, by and between TREASUP.E COAST AERIE N0. 3582
FRATERNAL ORDER OF EAGLES, INC., a Florida Corporation,
hereinafter referred to as "EAGLES", and H. B. MOORE and GLORIA
H. MOORE, his wife, hereinafter referred to as "t*OORE",
WITNF. S SETH:
WHEREAS, "Eagles" are the owners of that certain
parcel of land described in that certain Deed attached hereto
as Exhibit A and hereby made a part hereof and "Moore'' are the
owners of that certain land described in Deed attached hereto
as Exhibit B and made a part hereof; and
WHEREAS, there presently exists a wall which is the
south wall of the building owned by "Eagles" and the north wall ,
of the building owned by "Moore", which said wall is a party
wall between the respective buildings owned by the respective
parties.
NOW, THEREFORE, "Eagles" and "N~oore" for themselves,
their successors, personal representatives, heirs and assigns,
mutually agree as follows:
1. That the wall, hereinabove described, now dividing
the buildings of the respective parties hereto shall become and
remain a party wall of the respective buildings and of the
parties hereto, their respective successors, personal representatives,
~ heirs and assigns, so that each of them shall be at liberty to
use the wall in such manner that it will not interfere with
the equal use of the other half of the wall by the other owner.
2. Neither party hereto shall make any alterations ;
~ or additions to said party wall without the express written
consent of both parties, extent where routine maintenance of
the wall is required; provided, however, that by execution of
this Agreement both parties hereby consent to a doorway being
inserted in said party wall for the purposes of providing an
exit door through said wall at such location in said wall as
shall be determined by fire prevention requirements.
3. That the presently existing two air conditioning
a units which are now inserted into said party wall and service
the building of "Moore" shall remain in position in said Harty
wall.
'z 4. It is further agreed between the parties hereto, -
that this Agreement shall be perpetual and at all times be
