THIS GRANT OF EASEMENT, Made and executed this 2nd day of 3 O ~
Diarch , A.D. 197 9 , by THE PINES OF FT. PIERCE
DEVELOPMENT CORPORATION, a Flor1
a corporation having its ~ 7
principal place of business at Fort Pierce, Florida, hereinafter
called the Grantor, to THE CITY OF FORT PIERCE, a Municipal ~
corporation, for the use and benefit of the FORT PIERCE UTILITIES
AUTHORITY, whose post office address is P. O. Box 3191, Fort
Pierce, Florida 33450, hereinafter called the grantee:
WITNESSETH: That the grantor, for and in consideration of
the sum of $10.00 and other valuable considerations, receipt whereof
is hereby acknowledged, by these presents does grant and convey unto
the grantee for the use and benefit of the FORT PIERCE UTILITIES
AUTHORITY, the privilege and easement to construct electrical
distribution lines, water mains, and sanitary sewer distribution
lines over, across and under the following described lands situate
in St. Lucie County, Florida, to-wit:
LEGAL DESCRIPTION AS ON SCHEDULE A, APPENDED HERETO
and, including the right to trim, cut and keep clear of said
easement parcels all trees, shrubs and limbs which may endanger
the utilities equipr.?ent installed thereon, with the right to go
upon said land from time to time as may be necessary to construct,
maintain and repair said utilities equipment and installations.
No permanent structures or shrubbery shall be placed upon said
easement parcels.
AND the grantor hereby covenants with said grantee that it is
lawfully seized of said land in fee simple; that it has good right
and lawful authority to grant this easement.
(Wherever used herein the terms "grantor" and "grantee"
include all the parties to this instrument and the heirs,
legal representatives and assigns of individuals, and the
successors and assigns of corporations.)
IN WITNESS WHEREOF, the grantor has caused these presents to
be executed in its name, and its corporate seal to be hereunto
affixed, by its proper officers thereunto duly authorized, the
day and year first above written.
