ORDER ON DEFENDANT'S MOTION TO DISMISS
AND PLAINTIFF'S MOTION TO STRIKE
This Cause came on to be heard on March 22 , 1979 on
the Defendant's Motion to Dismiss the Plaintiff's Amended
Complaint and the Plaintiff's Motion to Strike Affirmative
Defenses, and the Court having heard the argument of counsel
and being duly advised in the premises it is herein.
ORDERED AND ADJUDGED as follows:
1) The Defendant's Motion to Dismiss the Plaintiff's

Amended Complaint is hereby denied.
~ 2) The Plaintiff's Motion to Strike Affirmative
Defenses is granted as to Paragraphs 4, 5, 6, and 8 of the
Defendant's~Answer to Amended Complaint and said paragraphs
are hereby stricken. Defendant ,is granted leave to amend
Paragraph 4 of its answer within 10 days from the date of
this Order. Plaintiff's Motion to Strike is denied as to
