PARTIAL RELEASE OF !~!ORTGAGE
KNOW ALL MEN BY THESE PRESENTS:
[WHEREAS, TRAFALGAR COMMUNITY DEVELOPERS, INC., a Florida corporation,
by Indenture of mortgage, dated the 20th day. of December, 1972, and re-
corded in the Office of the Clerk of the Circuit Court, in and for St.
Lucie County, State of Florida, in Official Records Book 207, page 557,
granted and conveyed unto NORTH TRAIL GOLF CLUB, INC., a Florida corpora-
tion and assigns, said mortgage assigned from NORTH TRAIL GOLF CLUB, INC.,
to FIRST NATIONAL BANK & TRUST CO. OF RIVIERA BEACH, which Assignment was
dated September 29 , 1976, recorded in Official Records Bood 258, at page
459, St. Lucie County, Florida, to secure the sum of ONE MILLION ONE HUN-
DRED T[~TENTY-FOUR THOUSAND SIX HUNDRED TEN AND 66/100 ($1,124,610.66) DOL-
LARS; and
[VHERRAS, said TRAFALGAR COMMUNITY DEVELOPERS, INC., conveyed its in-
;:erest in the real property, which real property is now owned by HOLIDAY
PINES, a Florida General Partnership; and
WHEREAS, the said HOLIDAY PINES has requested the said FIRS'" NATION-
AL BANK & TRUST CO. OF RIVIERA BEACH to release the premises hereinafter
described, being a part of said mortgaged premises, from the lien and op-
eration of said mortgage;
NOVJ, THEREFORE, KNO[~ YE, that the said FIRST NATIONAL BANK & TRUST
CO. OF RIVIERA BEACH, as well in consideration of the premises as of the
sum of TEN ($10.00) DOLLARS, and other good and valuable considerations to
it in hand paid by the said HOLIDAY PINES, at the time of execution hereof,
the receipt whereof is hereby acknowledged, does remise, release, quit-
claim, exonerate and discharge from the lien and operation of said mort-
gage, all that piece, parcel or tract of land, being a Hart of the premises
conveyed by said mortgage, to-wit: SEE. EXHIBIT "D", DATED APRIL 6, 1978,
FILE NO. 761003.1, ATTACHED HERETO AND INCORPORATED ~:F.F.'_'IN.
TO HAVE AND TO HOLD the same, with the appurtenances, unto the said
HOLIDAY PINES and assigns, forever freed, .exonerated and discharged of
and from the lien of said mortgage and every part thereof; PROVIDRD, always,
nevertheless, that nothing therein contained shall in anywise impair, alter
or diminish the effect, lien or encumbrance of the aforesaid mortgage on
the remaining part of said mortgaged premises not hereby released there- _
~ from, or any of the rights and remedies of the holder hereof.
IN VIITNESS WHEREOF, the said FIRST NATIONAL BANK & mFttS~' CO. OF
RIVIERA BEACH has caused these presents to be executed in its name, and
its corporate seal to be hereunto affixed, by its proper officers there-
unto duly authorized, this 13th day of _ March A.D, 1979.
