For value received, I, we or either of us, promise to pay without
defalcation, to the order of WILLIS A. DORMINEY and SYLVIA G. DORMINEY,
his wife, at 331 Pine Avenue, MacClenny, Florida 32063, the sum of
TWENTY TWO THOUSAND SEVEN HUNDRED EIGHTY FIVE and 49/100-------------DOLLARS
with interest from date at the rate of nine percent per annum, in the manner
following: Monthly installments shall be $225.00 on February 1, 1979, and
a like sum on the corresponding day of each like succeeding month thereafter
until the whole sum shall be fully paid with interest at nine percent on the
unpaid sums from time to time owing.
Granting option to the promisor the right of prepayment without
penalty. After maturity hereof, whether upon acceleration or in due coarse
all overdue principal shall bear interest at the rate of ten percent (10~)
until paid. The undersigned shall jointly and severally pay a late charge
of five cents ($.05) for each dollar ($1.00) on any installment, payment
of which is delinquent for more than fifteen (15) days.
Each installment first shall be applied in payment of the interest
t and then on the unpaid balance of the principal sum. If default is made
~ in the payment of any installment when due, then at the option of the holder,
E and without any other notice, all the remaining installments shall be due
and payable at once. Privilege is given to pay two or more installments
- at any installment maturity date, but this shall not extend the time of
maturity of any subsequent installment. Neither forebearance, nor acceptance
by the holder hereof after any default in any payment hereon shall be deemed
extension.
Each maker, surety and endorser hereof, jointly and severally,
waives demand, presentment, protest and notice of protest for non-payment
and further agrees to any extension of time of payment, either before or
after maturity, without notice to any of us; and to pay all costs of collection,
including a reasonable attorney's fee in the event of any default hereunder,
and hereby severally waives all benefit of homestead and exemption under '
the constitution and laws of each State of the United States, as against
this obligation or any extension of renewal hereof.
