SECTION II (the "Condominium") according to the Declara-
tion of _ Condominium thereof, recorded in Official Records
Book 304 at Pages 1396 through ~~pg~ of the Public
Records of St. Lucie . County, Florida as such Declaration
may have been amended by any amendments thereto
hereto filed in the Public Records of St. Lucie County,
Florida including, but not limited to, any amendment to
add the aforesaid Phase to the Condominium (if such
Phase be other than Phase I thereof

Grantee, by acceptance hereof, and by agreement with Grantor hereby ;
expressly assumes and agrees to be bound by and to comply with all of the
covenants, terms, conditions and provisions set forth and contained in the
aforedescribed Declaration of Condominium, including, but not limited to, the
; obligation to make payment of assessments for the maintenance and operation
of the Condominium which may be levied against the above described A art-
t ment. Grantee expressly acknowledges the existence of a Settlement Stipula _
r tion and Agreement for and Grant of Easements and Other Rights (the Setde
~ ment Stipulation") and a Declaration of Protective Covenants and Restrictions .
~ (the "Protective Cot~en?nts"), as hereinafter set forth. The Settlement Stipu- ,
¢ lation provides for this Condominium to be served by certain facilities of High E
p Point of Fort Pierce Condominium Section 1 and the Protective Covenants ;
provides for certain land use covenants upon the land areas described therein =
(including, but not limited to, portions of the land areas included within this
Condominium) and provides for certain drainage easements and other ease- i
ments and rights including, but not limited to, the "Raadway Easement",
~ "Sewage System Rights" ,"Water System Rights" and "Future Development
~ Property Drainage Easement", all as are more particularly described therein,
all in ~ addition to the other matters set forth in the Setdement Stipulation and
~ Protective Cavenants, which other matters include, but are not limited to, the
- obligation to p~}• certain "Assessments" as are respectively set forth in the
~ Settlement Stipulation and Protective Covenants. Grantee expressly acknowl-
edges and assumes the obligation to pay the amounts assessed against the
~ Apariment under both the Settlement Stipulation and Protective Covenants and
~ acknowledges that "Assessments" under both the Settlement Stipulation and
~ Protective Covenants against all properties now or hereafter inciuded within
