HomeMy WebLinkAbout0402 . t . ~ i t 1} • ' f the interior designs and arranqements of all units, to ? alter the exterior designs and appearances of units by ~ adding hurricane shutters, louvered doors and/or windows ! to such units or the Common Elements or Limited Common Elements immediately adjoining such units, in such styles as may be approved by a majority of the Directors, even thouqh portions of the Common Elements adjoining such units may be affected thereby, as lonq as, the Developer, or the unit owner makinq any such change or alteration, owns the . unit which is so altered or which immediately adjoins ~ Common Elements or Limited Common Elements which are so ~ altered; however, no such change shall increase the number # of units nor alter the boundaries of the Common Elements, f except the party wall between any units or the space ad- ' joininq any wall, hurricane shutters, doors or windows ~ affected by such an alteration, without an amendment to ~ this Declaration in the manner hereinbefore set forth. If ~ any chanqes in units are made, as provided in this para- ~ graph, so that such units are no longer accurately depicted ` in Exhibit 1, such changes shall be reflected by an amendment i to this Declaration with a survey attacheci thereto reflecting - such authorized alteration of units, and said amendment need ' only b~ executed and acknowledged by the owner of the said altered unit and~any holders of mortgages encumbering the j said altered units: Such a survey shall be certified in_ the manner required by the Condominium Act; provided, however, that no amenciment need be executed with respect to any change ! ; or alteration as described above in this paragraph; which changes only the interior designs and arrangements of a unit ~ or units and/or adds, removes or replaces louvered doors, ~ windows and/or hurricane shutters on a unit, units, or the j Common Elements or Limited Comriion Elements immediately ~ adjoining such units. If the floor space of more than one ~ unit is increased or decreased by any change or alteration ~ made by the Developer pursuant to this paragraph, the ` Developer shall apportion between the units the shares in the Common Elements appurtenant to such units and the shares ~ in the Common Expenses and Common Surplus of such units, and ~ ~ Surplus shall be duly noted in the amendment to the Declara- i tion reflecting such change in floor space. 3 _ ~ 2. ~ i Article XIV of the Declaration is hereby deleted in its entirety, ~ ; and the following new Article XIV is hereby substituted in lieu ~ E thereof : . ; ; ~ LIMITED COMMON ELEMENTS a ~ ~ ~ € Those areas reserved for the use of certain unit ~ ; owners or a certain unit owner, to the exclusion of ~ other unit owners, if any, are designated as "Limited - ?
