AS INCORPORATED IN AMENDMENT TO DECLARATION OF CONDOMINIUM OF HUTCHINSON ISLAND CLUB, A CONDOMINIUM THIS AMENDMENT AGREEMENT, dated the day of , t~ 1978, is made by HUTCHINSON ISLAND CLUB CONDOMINIUM SOCIATION, INC., a Florida corporation, not for~profit-(hereinafter referred to as the "Association"). W I T N E S S E T H: ~ ~ WHEREAS, ~utchinson Island Club, Inc., a Florida corporation (hereinafter referred to as "Developer"), executed and recorded that certain Declaration of Condominium of Hutchinson Island Club, a Condominium, recorded in Official Records Book 254, Pages 2128 - through 2201, inclusive, Public Records of St. Lucie County, Flo- rida, as amended (hereinafter referred to as the "Declaration"), containing as Exhibit 4 thereto the By-Laws of the Association (hereinafter referred~to as the By-Laws); - WHEREAS, the first paragraph of Article X of the By-Laws provides in pertinent part that until the first election of Directors of the Association, the Declaration may be amended by the~affirmative vote of two-thirds of the Directors; WHEREAS, all Directors of the Association have been appointed by ~ tfie Developer, and Unit Owners other than the Developer have not elected any Directors of the Association; i I WHEREAS, the Board of Directors of the Association has unani- € ~ mously approved the modification of the By-Laws set forth below ° and pursuant to Article VII of the Declaration, authorized it to be ~ i ; incorporated in an amendment to the Declaration; and ~ . ; WHEREAS, the Association desires to amend the By-Laws to ~ : ~ effect such modification and incorporate it in an amendment to the g ~ Declaration so as to comply with the requirement of Florida Statutes = Section 718.112 (Supp. 1976); NOW, THEREFORE, pursuant to Article VII of the Declaration and ~ ~ ` Article X of the By-Laws, the Association hereby amends the Declaration ~ and By-Laws as follows: ~ y ~ \ ~ ~ ~ ~ ` ~ : . ~ G ~ _ _ _ ~ ~ _ T~ r ~ .
