South 731.1 feet of that part of the NE 1/4 of the
SW 1/4 of Section 15, Township 35 South, Range 40 East,
lying East of U. S. #1 and the South 30 feet of the
West 175 feet of the North 310 feet of the South 731.1
feet of that part.of the NE 1/4 of the SW 1/4 of Section
~15, Township 35 South, Range 40 East, lying East of
U. S. #1, St. Lucie County, Florida.
Mortgagees acknowledge that they have concurrentZy with the
xecution and delivery of this instrument, conveyed the above-describe
roperty to Mortgagor and further acknowledge that said property is
currently encumbered by that certain mortgage from Mortgagees to
Vernon Jenkins and Dorothy H. Jenkins, his wife, in the original
rincipal amount of $300,000 dated February 1, 1971 anc~ recorded on
ebruary 1, 1971 in Official Record Book 189 at Page 2731 of the
ublic Records of St. Lucie County, Florida. (Hereinafter referred to'
as the Jenkins Mortgage.) Mortgagees warrant that the Jenkins mort-
age is in good standing and has a current outstanding principal ~
! aiance of $232,968.54. Mortgagees agree that it shall continue to
e their responsibility to promptly pay and discharge all obligations
~ under the Jenkins mortgage as they 3~ecome due. Mortgagees further
! gree to indemnify and hold Mortgagor harmless of and from any claim,
~ loss or damage on account of the existence of the Jenkins mortgage
~ and further agree that if they fail to promptty pay any sum due under
F the Jenkins mortgage, then Mortgagor, at its option, may pay the same
€ and deduct the amount of such payment, together with interest thereon
~ at the rate of 9 1/2$ per annum, from the next payment coming due
e under the promissory note secured by this mortgage. Upon request by
~ ortgagor, Mortgagee shall from time to time furnish Mortgagor with
~ copies of cancelled checks or other satisfactory evidence reflecting
~ that the Jenkins mortgage is current and in good standing. Mortgagees
~ further warrant that the Jenkins mortgage shall be paid in full and
; an appropriate satisfaction thereof recorded in the Public Records
' f St. Lucie County, Florida simultaneously with or prior to payment ~
in full of the promissory note secured by this mortgage.
