THIS CAUSE coming on to be heard, and being heard before the

undersigned Judge Presiding over the District Court, Buncombe
County, North Carolina, on Plaintiff's Temporary Custody Order
and Defendant's motion for alimony pendente lite, custodv~ child
support and attorney fees pendente lite, and the Court after
considering the file, hearir.g evidence of both the Plaintiff and
Defendant, and arguments of council, makes the follot~•ing findings
of fact for purpose of the pendente lite hearing:
FINDINGS OF FACT:

That the Plaintiff is a citizen and resident of Buncom~e County,
~lorth Carolina; t,iat the Defendant is a citizen and resident of
Buncombe County, :~iorth Carolina.

~ That the Plaintiff and Defendant were married to each other on
~ November 1, 1969, and two children have been born of the marriage,

t~ wit: Angela t~iright, present age of 6 and Melissa [~right, presen
age of 2.

~ That the Defendant constructively abandoned the Plaintiff on
~ July 10, 19?6, when she ran him from the home of the parties
throwing rocks at him and shooting at hir.i three times ~~ith a
= .22 rifle.
