That the Defendant, prior to July 10, 1975, had aban~oned the ~

~ That on the first occasion the Defendant abandoned the
Plaintiff she left the aforesaid minor children unattended~, leavin
~ instructions with the oldest child, who.was four and one half
years old at the time, on who she was to contact for her care.

That on each of the occasions the Defen3ant abandoned the
Plaintiff she established residency with the Plaintiff's brother,
David Wright, in various motels in the Asheville area and _
committed adultery with the said David Wright.

That the Defendant continues, and is presently carrying on an
a~ulterous relationship ~vith the Plaintiff's brother.

That the Plaintiff's brother maintains_a-home in his parents-~
house, but does not use the same; that since the Defenaant
constructively abandoned the Plaintiff on July 10, 1976, the

I Defendant has allowed the Plaintiff's brother to use her home

~ for purposes of taking showers, and the Defendant has ~ashed and
~
~ ironed the clothes of the Plaintiff's brother since July 10, 1976;
that David Wright's automobile is continuously parked at the
Defendant's home.

That due to the findings specified in Paragraph 9 hereof, the
Court specifically rejects David 4~right's testimony that he has
been."camping-out" since July 10, 1976.
