WARRANTY DEED ~ , ; THIS INDENTURE, made this day of , 19_, between HIGH POINT EQUITIES, INC., a Florida corporation, hereina ter referred to . as "Grantor", and GENEVIEYE J. BIELICKI, a widow , whose post office address is o o ny a n e, o r t ~ e r c e, , State of Florida 33450 , hereinafter referred to as "Grantee". ; WITNESSETH: That Grantor, for and in consideration of the sum of TEN (s10.00) DOLLARS and other good and valuable consideration paid by Grantee, the receipt of which is hereby acknowledged, has granted, bargained, and sold to Grantee and Grantee's heirs and assigns forever the following described rea2 property situated, lying and being in St. Lucie Cuunty, Florida, to wit: ~ The Condominium Parcel known as Apartment 317 D of - Phase 1 of HIGH POINT OF FORT PIERCE GONDOMINIUM SECTION II (the "Condominium") "according to the Declara- tion of Condominium thereof, recorded in Official Records Book 304 at Pages ~ 396 through 1~08 of the Public Records of St. Lucie _ County, Florida as such Declaration may have beEn amended by any amendments thereto hereto filed in the Public Records of St. Lucie County, Florida including, but not limited to, any amendment to add the aforesaid Phase to the Condominium (if such Phase be other than Phase I thereof). . Grantee, by acceptance hereof , a~d by agreement with Grantor hereby expressly assumes and agrees to be bound by and io comply with all of the covenants, terms, conditions and provisions set forth and contained ~in the . aforedescribed Declaration of Condominium, including, but not limited to, the obligaiion to make payr~ent of assessments for the maintenance and op~ration of the Condominium which may be levied against the above described Ap~rt- ment. Grantee expressly acknowledges the existence of a Settlement Stipula- tion and Agreement for and Grant of Easements and Other Rights (the "Settle- ment Stipulation") and a Declaration of Protective Covenants and ~testricLions (the "Protective Covenants"), as hereinafter set forth. The Settlement Stipu- ]ation provides for ihis Condominium to be served by certain facilities of High Point of Fort Pierce Condominium Section 1 and the Protective Covenants provides for certain Iand use covenants upon the land areas described therein (including, but not limited to, portions of the Iand areas included within this Condominium) and provides for certain drainage easements and other ease- ments and rights including, b~t not limited to, the "Roadway Easement", "Sewage System Rights", "w'ater System Rights" and "Future Development Property Drainage Easement", all as are more particularly described iherein, all in addition to the other matters set forth in the Settlement Stipulation and Protective Covenants, which other matters include, but are not Iimited to, the obligation to pay cerLain "Assessments" as are respectively set forth in the Settlement Stipulation and Protective Covenants.
