HomeMy WebLinkAbout1790 J 1 • 1 - ~ t • i - ARTICLE IX - POWERS OF TRUSTEE In administering all-trusts established hereunder, Trustee shall have the express powers enumerated herein, together with all other powers confered by law upon trustees generally, and may exercise them at any time and from time to time in any valid manner with or without court order, as follows: { Trustee, and the successors and parties serving in-their stead, shall be governed by the provisions of Chapters 737 and 738, Florida statutes, and as amended, that are not in conflict - with this instrument, and shall have all additional powers and protection granted by statute to Trustee at the time of applica- tion that are not in conflict with this instrument. In addition ar~d not in limitation of any common law or statutory authority, f and without application to any court, Trustee also shall have the powers and responsibilities described below to be exercised in Trustee's absolute discretion. P A. Entire Trust Estate. With respect to all assets in the Trust Estate of all trusts that may be created under this Trust f Agreement, Trustee shall have the following powers: ' 1. Sell, Borrow, Etc. With regard to both real and personal property, for the purpose of obtaining funds for payment of taxes, claims and making distributions, conversion into cash, mans ement of the = g property and for every other proper purpose; Trustee may acquire, retain, invest, reinvest, exchange, lease, sell, borrow, mortgage, pledge, transfer and convey in such manner OD . gv~K ?a~E1788 + s
