be payable to my estate, but excluding any property or trust
estate over which I may possess a power of appointment or
,disposition, I give, devise and bequeath to my daughter,
DOROTHY RAHME SMITH, if she shall survive me. In the event
my said daughter shall fail to survive me, I give, devise
and bequeath said remainder of my estate in equal shares to
my grandchildren, KAREN LOUISE SMITH, STEPHANIE LYNN SMITH,

DEBORAH ANN SMITH, DENNIS RAHME SMITH and DAVID E. RAHME, ~
who are then living, provided however, should any of my

grandchildren fail to survive me, but shall leave issue
surviving me, then in such event such issue shall take, per
stirpes and not per capita, the portion of my residuary •
estate which their deceased parent would have received if
living. It is my intention to exclude my grandson, RONALD
EVERETT RAHME, from receiving any benefits under this, my
last Will & Testament. 't

ARTICLE IV
If pursuant to this Will any portion of my resid-

uary estate is at the time of my death required to be dis-
tributed to any grandchild or issue of mine that has not
f attained the age of twenty-one (21) years, such property
shall be held by my personal representatives, as Trustees, ,g
as a separate trust for the benefit of such person, pending
attainment of that a e, and the Trustees ma in their dis-

cretion in the meantime and in res ect of the whole or an

part thereof, and in respect of any earnings from investment
of principal or income (a) pay the same directly to such
person so far as it consists of income, but. as to principal `
- only to the extent permitted by law; (b) pay the same to the
surviving parent or to the guardian of such person or to any

adult with whom such person resides; (c) expend the same for
maintenance, education (including college and graduate study),

and welfare of such person; and/or (d) retain and invest the
same for the benefit of such person until attainment of age
