THIS CAUSE coming on for hearing this 12th day of April,
1979,-upon the Motion for Apportionment and Attorney's Fees

and Interest, and the .Court being advised by Lowell N. Veach,
the attorney for the DOT that they had withdrawn their approval
on the Stipulation and the Court having heard argument of
counsel and.the Court being advised by the attorney for the
DOT that they had no objection to the withdrawal of the funds
in the Registry of the Court, and the Court being advised
by said attorney that the DOT would proceed with all haste
to bring this matter to litigation, it is upon consideration
ORDERED AND ADJUDGED as follows:
(1) That the Clerk of this Court shall pay out of the
Registry of the Court the sum of $26,563.00 to the law firm

of Brennan, McAliley, Hayskar & McAliley, as attorneys for ~
Adams Ranch, Inc., successors in interest to Scott's Ranch,
Inc.
(2) That if this cause i:s not set for trial by the 1st
week of December, 1979,. the attorneys for all parties of

record in this case shall be entitled to receive reasonable j
attorney's fees and costs incurred in this cause to be
determined at a fee and cost hearing before this Court. - -
