ORDER DENYING DEFENDANT'S MOTION TO SET ASIDE FINAL JUDGMENT, TO SET ASIDE DEFAULT AND TO STAY EXECUTION 9 THIS CAUSE came on to be heard before this Court t on April 2, 1979, on Defendant's Motion to Set Aside Final Judgment, to Set Aside Default and to Stay Execution. The Court, after hearing the testimony presented by Defendant and argument by counsel, and being otherwise fully advised in the premises, makes the following findings: 1. Defendant, who works as a long distance truck driver, is in a transient business. 2. Defendant is registered to vote in the State c ~ i of New York and drives under a license issued by that state. E 3. Defendant has a residence in the State of New York at which his wife presently resides. 4. Although the Defendant states that he~and his E 5 e wife are separated, no legal' separation exists and no evi- deuce was presented that a divorce is contemplated between the parties or has taken place. The last place of marriage ` of Defendant and his wife was New York. i 5.
