PARTY DEFENDANT, iJITH PREJUDICE
On *4arch 28, 1979, this Court entered an Order
dismissing the Counterclaim of the Third Party Defendant with
leave to file an amended pleading within ten (10) days from
the date of the Order. An amended pleading has not been filed
and the attorney having announced he does not intend to amend
the pleading, it is thereupon
ORDERED that the Counterclaim of the Third Party
Defendant, MARY ELLEN JOHNSON, against the Third Party Plaintiff,
AL JOHNSON, be, and it is hereby dismissed with prejudice. ~
