I, MYRON M. YARN, of St. Lucie County, Florida, do here-
by make, publish and declare this to be my First Codicil to my `
Last Will and Testament dated April 6, 1961. f-
I do hereby revoke clause II of my said Last Will and
Testament, and substitute in lieu thereof, the following provi-
sion, to be known as clause II of my said Last Will and Testament.
II .
If my wife, JEAN F. YARN, survives me, I give, devise
.and bequeath to her an amount equal to one-half of the value of
my adjusted gross estate as finally determined for Federal Estate
Tax purposes, less the aggregate value (as finally determined for
Federal Estate Tax purposes) of all cash, property or interests ~
in property passing to my wife other than under this clause of my #
Will, which are allowed as a marital deduction. It is my desire
and intention to take full advantage of the marital deduction
provisions of the Federal Internal Revenue Code and all of the

E rovisions and terms used in this Will shall be construed accord-

i~ ingly. My personal representatives shall select the assets,

either cash or property in kind, or both, which shall constitute
~ this devise and bequest, but there shall not be included among
a
! such assets any insurance on the life of my wife or any asset or
the proceeds of any asset which does not qualify for the marital
deduction; provided, however, that any assets to be so distributed,
including cash, shall be selected in such .manner as to have an
