Vimer Enterprises, Inc. will grant Or. Henry and his - i. successors a permanent easement over the strip of land above described. 4. This agreement shall be fulfilled on or before December 31, 1980. -If construction of the roadway is started by that date, a three (3) month extension for completion will be granted. If construction has not commenced by December 31, 1980, this Agree- ~ ment shall be null and void, each party free to go his own way with no obligation to the other. 5. Dr. Henry will supervise construction of the road and will responsible for the maintenance and necessary repairs, and liability insurance if needed, until such time as Vimer _ Enterprises, Inc., or its agents, commence to develope their land, using the roadway, at which time it shall be mutual obligation shared by both parties. - } 6.
