THIS CAUSE having come on for hearing before me upon the
Defendant's i4otion to Dismiss and Motion to Strike, the Court
being fully advised; in the premises and having had the benefit
of argument from counsel, it is,
ORDERED AND ADJUDGED that the Motion to Dismiss be and the
same is hereby granted as to Count II of the Amended Complaint
and the Plaintiff shall have fifteen (15) days to amend.
That the .remainder of the Motion to Dismiss and the Motion
to Strike are denied.
DONE AND ORDERED in Chambers at Fort Pierce, St. Lucie County,
