S T I P U L A T I O N
The undersigned parties do stipulate and agree that
they did enter into an oral stipulation on April 18, 1979, at
the Final Hearing in this cause, which was appro~ted by the
Honorable G. Kendall Sharp, Circuit Judge, of the Circuit Court

of the Nineteenth Judicial Circuit,_and the parties do further
stipulate and agree that it is their intention by these presents
. ~
to reduce said oral stipulation and agreement to writing pursuant ~
to Florida Rules of Civil Procedure, 1.030, and the undersigned `
parties do agree and stipulate with one another as to the following:
1. That primary custody of the minor child, DEREK ALAN -
i LUKE, shall be awarded by the Court to the Mother, MARY ELLEN GAETZ,

I and that the Mother shall absent unusual circuinstances, be required

to maintain custody in fact of the minor child, by having the minor

~ child reside with her. That the Mother is awarded custody subject

~ to reasonable and liberal rights of visitation to the Father, BENJAMIN
~
~ F. LUKE, and the paternal grandparents of the minor child, MR, and MRS.

~ STANLEY BORIS, as set forth hereinbelow, or as otherwise agreed to by

~ the parties.

2. The paternal grandparents of the minor child, shall have

the right to visit with the minor child and to have the minor chi?d

= visit with them in their home on every other weekend, from Friday at
~
~ 5:00 P.M. to Sunday at 7:00 P.M., beginning on the weekend of April
~ 27 through April 29, 1979, and on every other weekend thereafter. The ,
~ Mother, MARY ELLEN GAETZ, will deliver said minor child to the resi-
~
~ dence of the paternal grandparents on said Fridays and shall retrieve
~
