THIS CAUSE coming on to be heard on April 24, 1979
on Defendants motion to dismiss or stay and alternative~motion~
to compel arbitration, and the Court having considered argument
. of counsel and memoranda of law, upon consideration, said motion
is denied.
This is an action under a payment bond pursuant to
Florida Statute 255.05. Article 14.2 of the subcontract does
not limit the plaintiff to only bring a suit on the payment
' bond as a source for satisfaction upon rendition of award in
arbitration. None of the cases cited in defendants' memorandum
~ contain a clause similar to Article 14.2.
