' WHEREAS, the Plaintiff and Defendant herein are husband and

wife, are not presently living together in such relationship, and are engaged

in litigation in the Circuit Court for the County. of Macomb, in which DORRIS
` SESLER seeks a Judgment of absolute divorce from CIARENCE SESLER; and

WHEREAS, the parties have come to an agreement settling and
~ j; adjusting all their property rights; and
~
WHEREAS, both parties are fully cognizant of the rights, and
hereby enter into this Property Settlement with full knowledge of their rights
and of their own free will;

NOW THEREFORE, IT IS AGREED AS FOLLOWS:

' _ IT IS HEREBY AGREED AND UNDERSTOOD that this Agreement as

executed may be offered as an exhibit at the time proofs are entered with the

i Court for the Judgment of Divorce, and the terms hereof may be incorporated

by reference into the judgment of Divorce, in accordance with the rules and
practices of the Court. However, the terms of this Agreement shall not merge
