All of the provisions of this Agreement may be enforced by each of t ~ the parties hereto, or by any third party beneficiaries (i. e. , the children of the parties) in any court of law which has jurisdiction. The parties further acknowledge that this Property Settlement Agreement and the obligations of each a$'contained herein, constitute adequate and sufficient consideration to support all of the provisions of this Property Settlement Agreement, whether or not they may ultimately be included in the Judgment of Divorce or ~ . enforceable by the Court which grants the judgment of Divorce. j" PROPERTX SETTLEMENT 1 ~ The parties make the following disposition and settlement i with respect to their real and personal property: R IT IS AGREED that Defendant husband is awarded full and I i exclusive custody of the marital home located at 16950 Grettel Avenue, Fraser, Michigan and more particularly described as: ~ f~ 4i Lot 30, Moulin Rouge East Subdivision No. 1, part of the SW 1/4 of Section 32, Town 2 North, Range 13 East, City of Fraser, Macomb County, Michigan, according to the plat thereof as recorded in Liber 44, Pages 25 and 26 of Plats, Macomb County Records, + which the parties shall hold as tenants in common. IT IS FURTHER AGREED that upon mutual agreement of the I' parties , but in no event later than the time when the youngest child reaches _ f the age of eighteen (18), or graduates from high school, whichever occurs ! later, the marital home shall be sold. Defendant shall -pay the mortgage payments, taxes, insurance and assessments on said home.
