This mortgage also secures any :?nd all renewals and extensions of the promissory note referred to herein and secured hereby. and all installments !hereof, and also any other notes which h:?ve been or may be given to the Mort- gagee by the Mortgagor, and any other indebtedness of the Mortgagor to the Mortgagee which, however, shall not exceed at any one time the aggregate unpaid principal sum ot DOLLARS IS.....................). it being the specific intention that further advances may be made by the Mortgagee at its option to the Mortgagor, either prior to or after. the due dates of the above re[erred to promissory note hereby secured; and this mortgage is given for the specific purpose of securing any and all indebtedness by the Mortgagor to the Mortgagee in whatever manner the same may be evidenced or represented, until this mortgage is satisfied of record; and all covenants and agreements con- tained in this mortgage shall be applicable to all further and future advances made by the Mortgagee to the Mortgagor and all other indebtedness of Mortgagor to the Mortgagee, and any and all renewals or extensions thera~f. 16. If all or any part of the property or an interest therein is sold or transferred by Mortgagor, excluding la) the creation of a lien or encumbrnnce subordinate to this mortgage or Ib) the creation of a purchase money security inter- est for household appliances, then, in that event, the then outstanding principal balance of the note secured by this mortgage, together with accrued interest, costs and [uture advances, it any, shall immediately be due and Ix?yable. Any such transfer or conveyance made without satisfaction of this mortgage shall constitute n deG?ult under the note and mortgage securing same. 1?. If Mortgagee deems itse(t insecure, or upon the happening o[ any of the following events, each of which shall constitute a default hereunder, all liabilities of each Mortgagor to Mortgagee shall thereut~on or thereafter, at the option of Mortgagee, without notice or demand. become due and payable: (a) the death of any Mortgagor (which term shall mean and include each Mortgagor, ca-maker, endorser, surety and guarantor of this mortgage); (b) the filing of any petition under the Brankruptcy Act, or any similar federal or state statute, by or against any Mortgagor; ~(c) nn appli- cation [or the appointment of a receiver for, the making of a general assignment for the benefit of credi ors by, or the insolvency of any Mortgagor: Id) the entry of a judgment against any 11lorlgagor: (e) the issuing of any~ttachment or garnishment against any property of any Mortgagor; If) the taking of ho.4sesgion of any substantial part of 'the property of any Mortgagor at the instance of any governmental authority; (g) the dissolution, incompetency, merger,~consolida- tion; or reorganization of any Mortgagor. 18. This Mortgage Deed and the note it secures shall be construed only under the laws of the State of Florida. PROVIDED ALWAYS, and this mortgage is on the express condition, that it the Mortgagor shall well and tru~y_ pay unto the Iortgagee the said sum o[ money mentioned in said promissory note referred to herein and secured hereby and any renewals or extensions thereof, any further advances and any other indebtedness referred to herein, in what- ever form, and the interest thereon as it shall become due, according to the true intent and meaning thereof, together with all costa, charges and expenses, including a reasonable attorney's tee, which the Mortgagee may incur or be put to in collecting the same by foreclosure or otherwise, or in protecting the security of the Mortgagee, whether by suit or otherwise and shall well and truly keep, observe, perform, comply with and abide by each and every the stipulations, agreements, conditions and covenants of said promissory note and this mortgage as and when required thereby then this . mortgage and the estate hereby created shall cease and be null and void, otherwise the same shall remain of bindipg force and effect. - IN WITNESS WHEREOF the said Mortgagor has made, executed, sealed and delivered this mortgage on the day and year first above written.
