WHEREAS, the Mortgagor on May 1, 1979 paid ROBERT Dl. JERNIGAN ii

his one-half interest in the Promissory Note referred to above and
. received a Partial Satisfaction of Mortgage from ROBERT M. JERNIGAN •
thereby fully releasing all of his one-half interest in the j
Mortgage Deed and Note referred to above; and
WHEREAS the parties desire to make certain modifications
•and changes in the payment of said Promissory Note and in the
I
Mortgage securing the payment of said Promissory Note; l
NOW THEREFORE it is hereby. agreed by the parties hereto
that the Promissory Note from the Mortgagor to th_e Mortgagee

secured by the Mortgage dated August 1, 1978 and recorded in O.R. 1

Book 291 at Page 1513,1514 and 1515 of the Public Records of St.
Lucie County, Florida is modified as follows:

1. As of August 1, 1979 there will be an unpaid balance
j
of $27,331.87 due to Emily May Peed Beacom as Trustee. The payment
of said principal amount shall be due on August 1, 1980 and the
principal balance shall bear interest from the date of August 1,
1979 at the rate of 10$ per annum until paid and said interest shall
a
be payable semi-annually with the first interest payment being due
a
on February 1, 1980 and the second interest being due upon f
maturity with the full payment of the principal balance. '

2. It is expressly agreed to by the. parties that the Mortgage
F and Note referred to and this Modification Agreement shall riot be
assumable and that any attempt to assume the Mortgage Note or this

Modification Agreement shall be considered a default under the Note

and the Mortgagor shall have the right to accelerate payment,
foreclose, and seek any remedies available to her under the Mortgage
and Note referred to above. The parties agree that upon sale of
the above property by the Mortgagee the Note and Mortgage referred
to above shall be immediately due and payable.
3. Except as herein expressly amended, modified and changed,
the terms of said Note are hereby ratified, approved and confirmed.
