FINAL PARTIAL SUMMARY JUDGMENT
THIS CAUSE came on to be heard on May 15, 19?9 on Plain-
tiff's Motion for Summary Judgment and the-court having reviewed
the transcript of the stipulation between the Plaintiff and
Defendants dated October 11, 1978, and the Plaintiff's affidavit
and the court having heard the argument of counsel for Plaintiff
and counsel for Defendants, and the court finding that Plaintiff
is presently due the sum of $29,000.00 plus interest pursuant to
the stipulation dated October 11, 1978, which sum was due to be
paid to Plaintiff on March 20, 1979, and the court further finding
that the moneys agreed to be paid by Defendants on July 1, 1979
are not yet due and owing to Plaintiff, it is hereupon
i ORDERED AND ADJUnGED as follows;
1. Plaintiff DENNIS L. TRACHSEL shall have and recover
from the Defendants RICHARD FLANZBAUM, TREASURE COAST BUILDERS,

INC., and LANDPOWER INVEST!IiENTS, INC, and each of them, the principal
i
sum of $29,000.00 together with interest in the amount of $2902.90
for which sums let execution issue.
2. -That the court specifically reserves jurisdiction to
enter such orders or final judgment as may. be proper on the issue
of moneys due Plaintiff on July 1, 1979 pursuant to the stipulation
between the parties dated October 11, 1978. The court further

reserves jurisdiction to assess and tax costs in this action.
